Davanti Union Ltd has issued a strong rebuttal to allegations made in several online articles concerning the trial of Asiimwe Emmanuel in Criminal Case No. 834/2023 at Buganda Road Chief Magistrates Court.
The case centers on accusations of forgery involving company documents linked to Taifa Partners Ltd. The statement released addresses inaccuracies in the articles, which were titled:
“Shs 13 Billion Silo Project for Uganda Prisons Mired in Controversy”
“Asiimwe’s Innocence as Forensic Experts Fail to Link Him to Forgery”
“Taifa Partners Managing Latest Victim of Predatory Money-lending”
The company categorically denies the claims, presenting detailed evidence to counter the allegations.
Background of the Case
Davanti Union Ltd clarified its shareholding in Taifa Partners Ltd, stating that it owns 10 shares, acquired in July 2022 through legally documented transactions. The company emphasized that Asiimwe Emmanuel retains the majority ownership with 90 shares. A shareholder dispute had previously been raised by Asiimwe but was dismissed by the Uganda Registration Services Bureau (URSB) tribunal in July 2023.
The company dismissed claims that the ongoing criminal case is connected to any shareholder disputes, insisting it stems from allegations of forgery against Asiimwe Emmanuel.
Forgery Allegations: The press statement details five instances of forgery involving company resolutions and a power of attorney. According to the statement:
The alleged forged documents included resolutions to alter bank signatories and revoke previous powers of attorney.
The signatures of Okello Charles, then-company secretary, were allegedly forged. Evidence presented includes a forensic report from the Directorate of Forensics, which confirmed the forgeries.
Okello Charles testified that he was not present at the meetings cited in the documents, as he was in Soroti or Kasese at the time.
The statement further highlighted that the URSB had ruled against Asiimwe, expunging the questioned documents from its registry.
In response to false accusations, Davanti Union Ltd denied allegations of conspiring to imprison Asiimwe Emmanuel. It stated that as a shareholder, it had a duty to report criminal activities. The company emphasized that the accusations of predatory money-lending practices are baseless, as its relationship with Taifa Partners is defined by a joint venture agreement signed in July 2022.
The statement also disputed the claim that Asiimwe had been exonerated by forensic experts. It clarified that the handwriting expert’s role was limited to analyzing the signatures of Okello Charles and confirming their forgery.
On the project status, Davanti affirmed that the Shs 13 billion Silo Project for Uganda Prisons is progressing well, with 98% completion. The company dismissed allegations linking the project to the forgery case.
Davanti Union Ltd further accused journalists of unprofessional conduct, alleging that they published biased articles without seeking the company’s side of the story. The company challenged the journalists to substantiate their claims and demanded retractions, warning of potential legal action against the publishers.
Legal and Regulatory Outcomes: The company disclosed that all complaints filed by Asiimwe to various authorities, including the Director of Public Prosecutions (DPP), Inspector General of Government (IGG), and police, were dismissed due to lack of evidence.
It stated that the forged documents directly benefited Asiimwe, particularly in his attempt to appoint himself through a power of attorney.
Davanti Union Ltd maintains that the online publications misrepresent the facts of the case, aiming to tarnish the reputations of individuals and entities involved. The company reiterated its commitment to justice and transparency, urging responsible journalism while warning of legal repercussions for spreading misinformation.
