The court of Appeal has ordered a man who murdered his step sister and removed her body parts including her private parts and tongue, to serve the 32 years imprisonment term that was handed to him by the High Court in Kampala.
Lukenge Hussein was convicted of murder and sentenced to 32 years imprisonment term by justice Joseph Mulangira on the 27th of January 2016.
It was proved by the state that the appellant and others on the 17th December 2012 at Kibalama Zone Lukuli, Makindye Division Kampala District, unlawfully killed Nalwoga Shamim, a female adult who was his step sister.
It was the prosecution case that between 8th and 17th December 2012, the appellant, his Aunt Nasaka Hadija (who is at large) and grandmother Namuyanja Hanifa (who died in prison) took the deceased from her home and held her against her will in Namuyanja Hanifa’s house rented by the appellant.
The appellant rang the deceased’s father and informed him that they had his daughter and would bring her back after 4 days. On the 17th December 2012, the decomposing body of the deceased was found in the house occupied by Namuyanja Hanifa and upon examination of the body, it was found that some body parts like the intestines, the tongue and private parts were missing.
The appellant and Namuyanja Hanifa were arrested and their respective houses searched which led to the recovery of several exhibits including blood stained bed sheet, bed cover and two shirts, as well as a knife with a wooden handle.
The appellants were charged with murder, tried convicted and sentenced to 32 years’ imprisonment but dissatisfied with the lower court decision,they appealed accusing trial judge of convicting them on weak evidence and handing them a harsh and manifestly excessive sentence.
Three justices led by Deputy Chief justice Richard Buteera have upheld his conviction and sentences agreeing with the trial judge that there was over whelming evidence against the accused in the said murder.
In convicting Lukenge and his co accused person’s, justice Mulangira had noted that the convicts looked un- bothered and not remorseful even after finding them guilty.
The judge further ruled that the victim had met a painful death since her organs including intestines,private parts and tongue were removed and taken to un identified place.
