Senior Lawyers at Risk After Refusing to Provide Statements in Forgery Investigation

A high-stakes legal saga surrounding David Balondemu, the Kampala District Land Board Chairman, has taken a dramatic turn as five prominent lawyers, representing Balondemu, find themselves in the spotlight amid an investigation into alleged forged medical records used during a recent court proceeding.

The attorneys in question, namely Caleb Alaka of Alaka and Company Advocates, Hassan Kamba of Turinawe and Company Advocates, Robert Bautu of Arcadia Advocates, Evans Ochieng of Ochieng Associated Advocates, and Mukasa Mbidde of Mbidde and Company Advocates, are facing potential arrest for their refusal to provide statements regarding the purported falsified medical documents.

The investigation, spearheaded by the Criminal Investigations Directorate (CID) in collaboration with the State House Anti-Corruption Unit (SHACU), revolves around the alleged presentation of fabricated medical records during a bail application at Buganda Road Chief Magistrates Court on November 20, 2023, concerning Balondemu’s case.

Reports suggest that these documents were submitted to support Balondemu’s bail plea, indicating an urgent need for surgery on November 22, 2023.

Despite summonses dated November 24, 2023, requesting their appearance before the CID, the five legal representatives opted not to comply. Instead, they petitioned the Director of Public Prosecution, Jane Abodo, through Arcadia Advocates on Tuesday, November 28, 2023, outlining their stance.

The lawyers’ petition referenced their appearance for Balondemu’s bail application on November 21, 2023, and the subsequent events at Buganda Road Court. They highlighted that following the presentation of the medical records, the prosecution sought to expunge them due to allegations of forgery. The court, in response, scheduled a ruling for November 29, 2023, following counterarguments from the prosecution.

Furthermore, the petition addressed a complaint filed by Senior State Attorney Ivan Kyaze to SHACU against Balondemu’s legal team. It emphasized that the primary aim of the bail application was to safeguard their client’s rights, countering claims of personal gain.

Robert Bautu of Arcadia Advocates accused Kyaze of attempting to undermine Balondemu’s legal representation, asserting the lawyers’ dedication to fulfilling their obligations to their clients.

However, as of Tuesday, Director of Public Prosecutions, Jacquelyn Okui, stated that their office had not yet received the petition, adding an element of uncertainty to the unfolding situation.

Balondemu and his co-accused are embroiled in a case involving allegations of fraudulent activities, including the purported acquisition of over sh2.2 billion from an American company, KG Unlimited LLC. These alleged actions reportedly transpired while operating under the law firm M/S Bloom Advocates. On Monday, November 20, the defendants were remanded to Luzira Prison, with the court deferring the ruling on their bail application pending verification of the authenticity of the medical records presented by Balondemu.

The legal intricacies and potential repercussions of this case continue to unfold, casting a glaring spotlight on both the accused and their legal representation amidst an atmosphere charged with allegations and counterclaims.
