Tribunal Orders Cancellation of Street Lighting Contract on Entebbe Road

The Public Procurement Tribunal has made a landmark ruling, ordering the cancellation of the contract awarded to Green Power International Limited for the installation of street lighting along the Zana Mpala section of Entebbe Road.

Chaired by senior counsel Francis Gimara and supported by esteemed members including Nelson Nerima, Thomas Brookes Isanga, Geoffrey Nuwagira, Charity Kyarisiima, and Keto Kayemba, the tribunal directed the cancellation of the contract award and called for a fresh re-evaluation of the bids submitted for the project.

This decision followed an application lodged by Samanga Solutions Limited against the Uganda National Roads Authority (UNRA) concerning the contract awarded to Green Power International Limited, encompassing the installation of streetlights over a stretch of 19 kilometers.

During the bidding evaluation process, the tribunal highlighted a critical communication lapse within the evaluation committee. The chairperson of the committee had, in a letter dated September 8, 2023, requested additional documentation from Green Power International Limited regarding a certificate of completion of a prior contract, impacting the evaluation.

Upon the conclusion of the evaluation, Green Power International Limited emerged as the favored bidder at a quoted price of sh23 billion. However, this decision faced contestation from Samanga Solutions Limited, prompting the tribunal’s intervention and subsequent cancellation of the awarded contract.

In its ruling, the tribunal ordered a re-evaluation of bids for the installation of street lighting along the specified road section, emphasizing adherence to fair bidding processes, compliance with stipulated documentation, and the legal framework governing procurement procedures.

This significant decision underscores the commitment to uphold transparency, fairness, and adherence to due process in the country’s procurement and tendering processes, ensuring accountability and equity in public contracts.
